These General Terms and Conditions of Use (hereinafter the ‘GTCU’) are a contract between: Any person browsing the website: www.thebatikstore.com (hereinafter the ‘User’) AND the INDIVIDUAL COMPANY MONSIEUR NEO SZYZA registered under SIREN number 927 833 611 and domiciled at the address: 4 Rue Henri Dunant 33185 Le Haillan, France (hereinafter the ‘Publisher’).

Article 1. Subject

The purpose of these General Terms and Conditions of Use (hereinafter referred to as the ‘GTCU’) is to define the terms and conditions of use for any person browsing (hereinafter referred to as the ‘User’) the Publisher’s website (hereinafter referred to as the ‘Site’). The purpose of the Publisher’s Website is the distance selling of products. Exceptionally, the Publisher may agree to the modification, addition or deletion of provisions of these GCU by written agreement. The Publisher reserves the right to modify or update these TCs without justification or prejudice, which is why the Publisher recommends that Users systematically reread the TCs before browsing the Site again. The date of the last update of these GTUs appears at the top of this page in bold.

Article 2. Scope of application

These GCU apply to all Users visiting the Site. By accessing the Site, Users acknowledge that they have read and accepted these GCU, which set out their rights and obligations when browsing the Site.  

Article 3. Website

1. Accessibility

The Publisher’s Site is located at the following address: www.thebatikstore.com. Access to the Site is free of charge for all Users with Internet access. However, the costs incurred by the User for connection to and use of the Internet shall not be borne by the Publisher. All Users acknowledge that they are over 16 years of age or that they are accompanied by a legal guardian in order to browse the Site.  

2. Contents

The Publisher uploads the content to the Site and takes all possible steps to ensure the accuracy and validity of the information uploaded to the Site. The Publisher reserves the right to modify or update the content without justification or prejudice. It is possible that the content of the Site may contain inaccurate, incomplete or erroneous information as a result of a technical or involuntary error on the part of the Publisher. The Publisher undertakes to correct such errors in good faith and as soon as possible after becoming aware of them.

Article 4. Personal data and cookies

The Publisher undertakes to maintain the confidentiality of Users’ personal data and browsing data only. Personal data may be processed in particular to process orders placed on the Site or to create a customer account. Browsing data is used to facilitate the User’s browsing of the Site. If and only if the User consents, his/her personal data and browsing data may be processed by the Publisher. The Publisher undertakes to ensure compliance with the provisions of the General Data Protection Regulation 2017/679 (GDPR) of the European Parliament and of the Council dated 14 April 2016 by ensuring compliance with retention periods, the need to collect the aforementioned personal data, and the confidentiality of the personal data collected. Article 5. Hypertext links

The Publisher’s Site may contain hypertext links redirecting Users to third-party sites. The Publisher is not responsible for the page to which the hypertext link redirects Users, nor even for the use that may be made of this link. The Publisher warns Users of the risks arising from these links and recommends that Users use these hypertext links with caution.

Article 6. Intellectual property rights

All material on the Publisher’s Site is protected by copyright under the French Intellectual Property Code. Any reproduction, exploitation, redistribution or use, even partial, of the elements, including legal and administrative documents, present on the Publisher’s Site is prohibited.  

Article 7. Liability

The Publisher confirms that it takes all necessary measures to ensure the proper operation, security and accessibility of the Site. The Publisher is bound only by an obligation of means and not of results with regard to the measures taken to ensure the proper operation, security and accessibility of the Website. The Publisher may not be held liable in the event of :

  • malfunction, security failure or unavailability of certain services on the Site;
  • direct or indirect damage resulting from information on the Site.

The Publisher cannot be held liable for any damage caused to the User or to third parties as a result of the User’s use of the Site in breach of these GTC. The User is solely responsible for the use made of the Site and undertakes to indemnify and compensate the Publisher for any damage, loss or loss of profit caused to the Publisher by the User during use of the Site.  

Article 8. Partial nullity

Si une ou plusieurs dispositions des présentes CGU sont tenues pour non valides en application d’une norme en vigueur ou d’une décision définitive d’une juridiction compétente, les dispositions non affectées par cette non validité restent applicables dans leur intégralité.

Article 9. Applicable law and jurisdiction

These GCU are governed by French law. In the event of a dispute arising between the User and the Publisher, the parties will endeavour to resolve the dispute amicably. Any dispute relating to the interpretation and/or performance of these GTUs shall be subject to the jurisdiction of the French courts.
